Customer walks into glass store door, sues Apple for $1 million

CBS New York reports that 83-year-old Evelyn Paswall is suing Apple after breaking her nose on a glass door at the company’s Manhasset, New York, Retail Store. The octogenarian has requested a total of $1 million from the Cupertino company, which includes punitive damages for negligence, and medical expenses.

From the report:

“Paswall claims that she didn’t realize that she was walking into a wall of glass as she approached the store, and says that she broke her nose as a result of the collision.”

The New York Post also reports that in her lawsuit, Paswall argues that Apple should have placed marks on the glass that elderly customers could see:

“The defendant was negligent . . . in allowing a clear, see-through glass wall and/or door to exist without proper warning”

Apple did in fact place white strips on the glass of all their retail stores after a similar incident occurred last year. But it would appear that the strips on the Manhasset store aren’t clear enough, at least not to Paswall, or her attorney:

“There were no markings on the glass or they were inadequate,” he said. “My client is an octogenarian. She sees well, but she did not see any glass.”
